LinkedinHeadshots.ai ("LinkedinHeadshots", "we", "our", "us") is owned and operated by Totalremoto LLC, a Wyoming company. We are an independently owned company that takes your privacy seriously. By accessing or using LinkedinHeadshots.ai ("Site" or "Service"), you agree to be bound by the following Terms of Service and Privacy Policy ("Terms"). If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using our Service, you agree to comply with and be legally bound by these Terms. We reserve the right to modify them at any time by posting updates to this page. Continued use after changes constitutes acceptance of the new terms.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our Service. By uploading photos of yourself or others, you confirm you have explicit, written consent to do so. Parents or legal guardians must consent for minors if applicable.

3. Rules and Conduct

You agree to use the Service only for lawful purposes. You may NOT:

• Upload photos of minors (under 18) or without explicit consent.
• Use the Service to create deepfakes, impersonations, political content, scams, or any misleading, harmful, illegal, or obscene content.
• Generate AI models or headshots for politically exposed persons without consent.
• Generate nudes, pornography, or offensive/abusive materials.
• Circumvent security features or scrape, copy, or exploit the Service without permission.

We reserve the right to monitor, remove, and report illegal or harmful content and will cooperate with law enforcement as needed.

4. Licensing and Ownership

Subject to compliance with these Terms:

• You own your generated headshots: You retain full ownership and commercial rights to all headshots generated using our Service.
• You may use your generated headshots for any lawful personal and commercial purposes without restriction.
• We do not claim any ownership rights to your generated headshots or uploaded photos.
• You grant us a limited license to use uploaded inputs solely to provide the Service and generate your headshots. This license terminates when your data is deleted.

5. Fees and Payments

• Paid subscriptions begin immediately after purchase and you waive any statutory withdrawal rights.
• Satisfaction Guarantee: If you don't get professional headshots that meet your expectations, we will provide a full refund within 7 days of delivery, no questions asked. Note: Downloading any generated headshots forfeits your right to a refund, as you have received the digital product in full.
• Subscriptions automatically renew unless cancelled before renewal.
• You are responsible for applicable taxes.

6. Termination

We may terminate or suspend your access at our discretion if you violate these Terms. Upon termination, all rights granted to you cease. Termination does not affect obligations and liabilities incurred prior.

7. Indemnification

You agree to indemnify and hold harmless LinkedinHeadshots.ai, Totalremoto LLC, and their affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

8. Limitation of Liability

We provide the Service "AS IS" without warranties. To the maximum extent permitted by law, our liability is limited to the amount you paid us or $100, whichever is greater. We are not liable for indirect or consequential damages.

9. Privacy Policy and Data Protection

Information Collection:

We collect personal information (such as name, email, photos) directly, automatically, and via third parties, including:

• Identifiers and device data
• Usage data (pages visited, time spent, interactions)
• Uploaded content (photos, text prompts)

Use of Information:

We use your information to:

• Provide and improve the Service
• Communicate with you
• Provide customer support
• Comply with legal obligations

Sharing of Information:

We may share data:

• With service providers under strict privacy obligations
• To comply with legal requirements
• To prevent fraud and abuse

Security:

Data Retention and Deletion:

Automatic Data Deletion:

• Training photos (photos you upload) are automatically deleted after 7 days of processing completion.
• Generated headshots are automatically deleted after 30 days of creation.
• You can delete your data faster at any time through your account settings with immediate effect.
• Account data (email, payment information) is retained as long as your account is active, unless you request deletion.

User Control: You have complete control over your data and can request immediate deletion at any time by contacting us or using the delete function in your account.

International Transfers:

Your data may be processed outside your country. By using the Service, you consent to this transfer.

10. Rights of EEA, UK, Swiss, and California Users

We comply with GDPR, UK GDPR, and CCPA. Your rights include:

• Access and knowledge of what data is collected
• Correction or deletion of data
• Objecting to processing
• Data portability
• Not being discriminated against for exercising your privacy rights

Repeat infringers will have their accounts terminated.

12. Arbitration, Governing Law, and Dispute Resolution

Governing Law:

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws.

Arbitration:

Any dispute arising from these Terms shall be resolved by binding arbitration on an individual basis in Wyoming. Users waive rights to jury trial or class action participation.

Opt-Out:

You may opt out of arbitration within 30 days of accepting these Terms by notifying us at support@totalremoto.com with your full name and email address.

Small Claims:

Either party may pursue a claim in small claims court in Wyoming instead of arbitration.

13. Waiver and Severability

If any provision of these Terms is unenforceable, the remaining provisions will remain in effect. No waiver of any term shall be deemed a waiver of any other term.
